Does Wisconsin's no-purchase sweepstakes concept make a dual-currency casino exempt?

Not automatically. Section 945.01(5) has specified no-consideration methods for lotteries, but the Supreme Court said those exceptions do not simply transfer to the gambling-machine definition. A platform must be evaluated on currency, redemption, device, and entry mechanics.

What the law says

Wisconsin Statute section 945.01(5) defines a lottery as an enterprise in which, for consideration, participants get a chance to win a prize and chance determines the award. Its consideration definition is broad but lists certain no-purchase promotional methods. Section 945.02 criminalizes making a bet, entering a gambling place, or conducting a lottery, and section 945.03 makes specified commercial gambling conduct a Class I felony. These are enacted provisions and do not name dual-currency online casinos.

How it applies to dual-currency casinos

The Wisconsin Division of Gaming FAQ says it regulates raffles but does not regulate sweepstakes and directs readers to consumer-protection guidance. In Quick Charge Kiosk LLC v. Kaul, 2020 WI 54, the Supreme Court explained that the lottery subsection's consideration exceptions are distinct from the gambling-machine definition. That distinction matters for a dual-currency platform: a free entry route may be relevant to lottery consideration, while purchased currency or a device-like product may trigger separate analysis. No Wisconsin operator-specific action concerning an online dual-currency sweepstakes casino was located in the reviewed sources.

Enforcement on file

The reviewed record has statutes, Division guidance, and a Supreme Court interpretation of consideration. No named online sweepstakes-casino action was located in the reviewed official sources. That does not establish that no action exists elsewhere.

Still unresolved

Whether purchase of Gold Coins or another benefit is a commercial advantage or disadvantage, and whether the platform operates as an enterprise or gambling machine, remains product-specific.
