Did the West Virginia Attorney General opinion decide the status of sweepstakes casinos?

No. The opinion involved a described daily-fantasy product and declined to reach a gambling-law conclusion on the available chance-versus-skill evidence. It illustrates a fact-specific boundary rather than resolving dual-currency products.

What the law says

West Virginia Code section 61-10-5 makes betting or furnishing money or another thing of value for a game of chance a misdemeanor. Its stated fine ranges from $5 to $300, with possible county-jail consequences when a fine, costs, or required bond are not satisfied. Section 61-10-11 separately addresses promoting or managing a lottery or raffle for money or another thing of value and provides a different misdemeanor penalty.

How it applies to dual-currency casinos

An August 6, 2025 Attorney General opinion supplies an important limit on broad conclusions. It discusses the state constitution's private-lottery prohibition and related code sections, but declines to decide whether a described daily-fantasy product violated gambling law because the evidence did not resolve the role of chance versus skill. The opinion concerns fantasy sports, not dual-currency sweepstakes casinos. Its value here is methodological: West Virginia's broad provisions warrant caution, while the classification of a specific product still depends on its facts and evidence.

Enforcement on file

The official sources reviewed contain general gambling and lottery provisions plus an Attorney General opinion about fantasy sports, but no named enforcement action or court decision classifying an online sweepstakes-casino operator.

Still unresolved

West Virginia's unresolved question is how much chance, consideration, and redeemable value a specific dual-currency product presents under the statutes, a factual record the fantasy-sports opinion did not supply.
