Does New Hampshire's gambling-machine scope clearly cover an internet-only dual-currency site?
The reviewed statute does not provide a clear answer. Its sweepstakes provision refers to a machine furnished by the operator or related party in an establishment with specified control or affiliation. Whether a remote browser or app satisfies those terms remains unresolved.
What the law says
New Hampshire RSA 647:2 makes unlawful gambling and gambling-machine conduct criminal. It defines gambling as risking something of value on a future contingent event, defines a gambling machine to include a device capable of running sweepstakes or displaying prizes, and defines sweepstakes as a game or promotion with or without consideration where chance determines a prize. A scope provision says this sweepstakes chapter applies when the entrant uses a gambling machine furnished by the operator or related party in an establishment controlled, affiliated, or contracted with the operator. RSA 647:1 separately addresses unlawful lotteries.
How it applies to dual-currency casinos
The scope language is enacted law and is material to an internet-only product. It does not automatically decide whether a browser or mobile app is a covered gambling machine or whether remote access satisfies the establishment relationship. Purchased Gold Coins, free Sweepstakes Coins, AMOE, redemption, prize display, and affiliate or facility control remain factual questions. The 2025 SB168 proposal would have addressed internet gambling, but the official page marks it died on the table or inexpedient to legislate, so it is not current authorization or prohibition. The statutory injunction provision provides enforcement authority but is not proof of a case.
Enforcement on file
RSA 647:2 authorizes state or local officials to seek an injunction, but no reviewed source named a modern internet dual-currency operator or documented a related action. SB168's status is a proposal outcome, not enforcement.
Still unresolved
Whether a remote web or app product uses a covered gambling machine and establishment relationship, and how value applies to purchased play currency, free redeemable currency, and AMOE, remains unresolved.
