Can a Nebraska gift enterprise use a dual-currency casino-style game?
Section 9-701 does not answer that automatically. The promotion must satisfy its no-required-consideration and disclosure rules, and the statute excludes certain electronic game facsimiles and slot machines. Purchase, free-entry, display, prize, and redemption mechanics require separate analysis.
What the law says
Nebraska's criminal code defines gambling as betting something of value on chance or a future event or participating in an unauthorized scheme. It defines gambling devices broadly to include electronic or computer devices capable of awarding value or free plays redeemable for value. Promoting gambling can be a misdemeanor or felony depending on conduct and daily value. Separately, section 9-701 permits a qualifying gift enterprise as a business promotion, but entry and winning cannot require payment or valuable consideration except a product or service purchase at no greater than its normal price. The section excludes slot machines and certain electronic game facsimiles.
How it applies to dual-currency casinos
Article III, section 24 frames constitutional limits, while section 9-701 provides a promotion framework with disclosure duties and Department of Revenue enforcement authority. The reviewed enacted provisions do not create a broad online dual-currency sweepstakes-casino classification. A site with purchased Gold Coins, free Sweepstakes Coins or AMOE, prize redemption, simulated casino play, and a separate purchase price may or may not fit the gift-enterprise conditions. Whether online play is a prohibited electronic facsimile or an authorized promotion is product-specific.
Enforcement on file
No action naming a current dual-currency platform was located in the reviewed sources. Section 9-701 authorizes injunctions and civil penalties for unlawful gift-enterprise practices, but statutory authority is not evidence that a particular case occurred.
Still unresolved
How Nebraska agencies and courts will apply the gift-enterprise and electronic-device exclusions to a remote website or app offering purchased and free currencies with prize redemption remains unresolved.
