Did Massachusetts House Bill 4431's online-sweepstakes prohibition become law?

No. The official bill history shows H4431 was accompanied by a study order. Its online-sweepstakes definition and proposed prohibition are not enacted law. The operative sources reviewed are chapter 271, section 7, and 940 CMR 30.00.

What the law says

Massachusetts General Laws chapter 271, section 7 criminalizes setting up or promoting an unlicensed lottery or disposing of property by chance as an inducement to a sale, subject to its statutory language. Attorney General regulation 940 CMR 30.00 addresses illegal lotteries, sweepstakes, and de facto gambling establishments, and distinguishes free play from participation requiring something of value. House Bill 4431 proposed internet gaming and expressly defined an online sweepstakes game as a dual-currency internet game with cash or cash-equivalent prizes. Its official history shows that it was accompanied by a study order on March 23, 2026, not enacted.

How it applies to dual-currency casinos

The proposal's detailed definition is legislative context only and cannot be presented as a current Massachusetts sweepstakes ban. The enacted statute and Attorney General regulation require product-specific attention to consideration, chance, prize value, purchase inducement, and the no-purchase route. The Attorney General's June 25, 2025 cease-and-desist release against BetOnline.ag and Sportsbetting.ag is a specific action against unlicensed offshore casino and sports-betting operators, but it does not name a dual-currency sweepstakes operator. Direct mass.gov pages returned access-denied responses in this review, although official indexed content and URLs were available.

Enforcement on file

Adjacent action found: the Attorney General sent cease-and-desist letters to BetOnline.ag and Sportsbetting.ag in June 2025 for unlicensed online casino and sports betting. No named dual-currency sweepstakes action was located in the reviewed sources.

Still unresolved

Whether a particular dual-currency product falls within chapter 271 and 940 CMR 30.00, especially where an AMOE and cash-equivalent redemption are offered, remains unresolved.
