Why does Idaho's merchant-promotion exception not settle the page by itself?

The exception sits beside constitutional language about casino simulations and a statutory definition based on risking value for gain. A specific product must be evaluated against the complete set of provisions, not one label or one exception.

What the law says

Idaho Constitution article III, section 20 says gambling is contrary to public policy and strictly prohibited except for an authorized state lottery, pari-mutuel betting, and qualifying charitable bingo and raffles. It also bars those permitted activities from using casino gambling or electronic or electromechanical imitations or simulations of casino gambling. That simulation language makes Idaho's constitutional text unusually specific for this page family.

How it applies to dual-currency casinos

The same constitutional section excludes merchant promotional contests conducted incidentally to a bona fide nongaming business when participants are not charged consideration, along with games that award only additional play. Idaho Code section 18-3801 uses a separate value-and-chance definition and repeats those exclusions. The state-specific issue is not simply whether a site calls itself a sweepstakes. It is how the prize path, payment structure, and casino-style simulation fit together under both provisions. Neither official source names the modern dual-currency model directly.

Enforcement on file

The Idaho constitutional and code sources reviewed do not identify a state enforcement order or court decision against a named online sweepstakes-casino operator. The absence is a result of this official-source review, not proof that no action exists elsewhere.

Still unresolved

The unresolved Idaho issue is how a particular dual-currency product fits the no-consideration merchant-promotion exception when its games also imitate casino gambling.
